Mandated reporter voices concern that a child #XXX XXXXX may have been at risk of neglect.  The reporter notes that he spoke with OCCS investigator Fernando Lazu who informed him that he learned that Maria Cupo, the Director of Piccolo Mondo, was operating outside of her limited school age license.  she was failing to provide supervision to staff members.  There were no reference checks completed regarding Mr. Garcia.  The reporter told Mr. Lazu that in April 2002 XXXX and another person were at the program for the CHIP Program.  They took a short cut through the a rear hallway.  children were sitting on the floor in the hallway with an adult and appeared to be having a class there.  Lazu stated that it was a violation operating outside of a licensed area.

Mr. Lazu then said in his investigation that he learned that the Director hindered and misled investigators in the investigation made in behalf of #XXXX XXX and @XXXX XXXXXXX.

This information was faxed on 7/31/2002 to DSS and a record search indicated that n investigation was currently open with Mary Blake.  Sup Crowley advised investigator of this information that involved administrative concern that the Office of Child Care Service became aware of.

This was the 51A being investigated on August 19, 2002 when the media was present at Piccolo.

This 51A was "Screened OUT" against Ms Cupo and no further investigation of these charges are permitted by MGL119 section 51B

A mandated reporter form received by this reporter named #X Xxxxxxx as a reported child of neglect by the Day Care Director Maria Cupo, because her interference in a sexual abuse investigation may have placed him at further risk.

conclusions

Allegations of sexual abuse of xxxxxx xxxx and xxxxxx xxxxx by Frank Garcia are supported for the following reasons:

Allegations of neglect of #xxxx xxxxx and @xxxxx xxxxxxx by Daycare Director, Maria Cupo are supported for the following reasons:

1. Despite her role as a mandated reporter, Mr. Cupo failed to report allegations of sexual abuse within a reasonable time period after receiving the information.

2. Parents contacted darning the investigation describe a pattern of misrepresentation on Mr. Cupo part. Ms #xxx and Ms @xxxxxxx have reported to DSS and/or OCCS that Ms Cupo misled them to believe that allegations of sexual abuse by Mr. Garcia were exaggerated and their children were not at risk.

3. Collateral with police as well as with parents indicate that Mr. Cupo repeatedly advised  parents to re-question their children, rather than providing support and the appropriate DSS referrals.

Through these deliberate actions, Ms Cupo directly impeded and interfered in the protection of those children under her care, placing them at further risk.
