There has been another delay in the trial of the Rev. Andrew Bierkan, a minister of the United Church of Christ.

 

Originally scheduled on the Worcester Superior Court for March 13, 2004, court documents state the trial was delayed at the request of Rev. Bierkan.

 

The trial was again slated on the court docket for May 25, at which time the docket reads the trial was rescheduled by the court before that date.

 

The trial was then rescheduled for June 7, 2004 and once again the trial was rescheduled by the court before this date.

 

Yesterday, Aug. 30, 2004, the trial of Rev. Andrew Bierkan was moved from criminal session 1 to criminal session 2 and again rescheduled for trial Aug. 31, 2004.

 

Rev. Bierkan, formerly minister at First Congregational Church of Sutton, is charged with one count of unnatural rape of a child that occurred on various dates between Oct. 5, 1989 and April 30, 1992; one count of posing a minor in a state of nudity on various dates between Oct. 5, 1989 and April 30, 1992.

 

Members of the Sutton Police Department investigated this case.  The complaining witness and her family attended the church.  

Worcester District Attorney John J. Conte has place this case within his so called clergy cases on his web site. The voice sees this as a sad attempt of smoke and mirrors by DA Conte to make himself look like he is prosecuting the Worcester dioceses catholic priest when in reality he has failed to prosecute any.

A former priest in the Diocese of Worcester the Rev. David L. Blizard, 57 was found innocent of charges of assault and battery of a person over 14 on August 17, 2004 in Brockton Superior Court.

 

Worcester District Attorney John J. Conte initially investigated but turned the case over to the Plymouth County district attorney because the offense allegedly happened July 25, 1988, in Wareham.

 

This is the second recent criminal court case that was initiated by an investigation from Worcester District Attorney John J. Conte office, which has resulted in the exoneration at trial.  Brother Louis Laperle, was found innocent in Fitchburg district court in March.

DSS probes case of boy hit by truck

LEOMINSTER -- The Department of Social Services is investigating how a 5-year-old boy was hit by a pickup truck Tuesday while walking with his father.

Matthew Derry, 5, of 22 Lorchrist St., was struck by a Chevrolet pickup truck driven by Bennie Baca of 5 Calva St., on Viscoloid Avenue.

The boy's father, Timothy Derry, said Wednesday the driver was at fault, despite DSS's investigation into possible neglect in the case.

Denise Monteiro, a spokesman for DSS, said the agency received an anonymous complaint Tuesday night on the 24-hour Child-At-Risk Hotline.

The matter was transferred to the North Central Massachusetts branch of DSS, which was investigating the matter with the Derry family Wednesday.

Voice note: A 6 year old FOSTER child, in state custody can fall out a second floor window unsupervised, then be discovered alone two blocks away injured and  DSS finds no neglect.  A truck in a street hits a 5 year old child who darts out and the Natural parents are now subject to a neglect charge from a so called anonymous complaint!  DSS is out of control, and should be subject to a CRIMINAL INVESTIGATION. However, your children are of little concern to DA John Conte who continues to turn a blind eye and fail our children.  All while his friends that surround the child abuse "cottage Industry" continue to line their pockets and grow wealthy at the expense of Worcester County children.

Defendants battle to keep out evidence about church's manual

Is the 1962 Vatican document called Crimen Sollicitationis a blueprint for the cover-up of clergy abuse within the Catholic church, or is it merely an internal policy manual for handling certain kinds of abuses within the sacrament of confession?

Lawyers are battling this issue out in the context of several civil lawsuits filed by alleged clergy abuse victims around the country.

The issue moves to Washington, D.C., today as the Rev. John P. Beal, a canon lawyer who said he has studied the Vatican document, is scheduled to be deposed this morning in connection with a Texas civil suit involving the Rev. Thomas H. Teczar of Dudley, Mass., a priest of the Diocese of Worcester.

Worcester's DA Conte has failed to act on clergy sexual abuse.

The Worcester District Attorney first issued a subpoena for clergy abuse information in April 5, 2002.

District Attorney John J. Conte in 2004 listed 57 priests as being subject to sexual abuse allegations.

In all this time, was there not one piece of evidence that would lead to prosecution of those responsible for crimes against children and adults of the Worcester Diocese?

One must wonder what the district attorney’s office has been doing in all this time.

2 boys in DSS case turn up

Fitchburg parents grilled by judge Children appear at court

WORCESTER- The two sons of a Fitchburg couple charged with contempt of court for refusing to disclose the sons' whereabouts were left yesterday by an unknown adult at Worcester Juvenile Court, then turned over to the state Department of Social Services.

"I had nothing to do with it. I saw the children here," said Mr. Hession, who has been involved in many cases against the DSS and has an anti-DSS Web site, MassOutrage.com, which describes "actual tactics used by the DSS to illegally kidnap children from families."

Outside court, Ms. Richard and Mr. Hession lashed out against the DSS.

"The children were safe and they didn't want to go to the DSS," Ms. Richard told reporters. "I did nothing wrong. I've been a mother for 16˝ years and I've been wrongly accused of neglect, and my husband has been accused of abuse and my children have never been abused."

Mr. Richard, whom his wife described as self-employed, declined comment. Ms. Richard said she cleans houses and takes care of children for a living.

Mr. Hession charged that the DSS had pressured Ms. Richard to get restraining orders.

"This is totally contrived," he said. "This involves egos and judges. These restraining orders are used as a weapon. This is one of the dirty tricks they use to break up families."

The Richards, Mr. Hession continued, "have a good relationship despite the stress of this and they look forward to living together."

The abuse restraining order law is one of the worst tyrannies ever foisted upon the people in this Commonwealth. It has destroyed more families, scarred more children, and caused more pain, than any law except the parallel child abuse statute. Mother of two behind bars

Judge demands children's location

WORCESTER- A judge ordered yesterday that a Fitchburg woman remain behind bars until she reveals the whereabouts of the two children she and her husband were supposed to surrender to the state Department of Social Services last month.

Judge Carol A. Erskine found Annette Richard, 36, in civil contempt after a hearing in Worcester Juvenile Court and ordered that she be held in custody at Framingham State Prison until Aug. 30, when another hearing will be held.

Voice note: The Richard family made the only choice to protect their children. Judge Carol A. Erskine, should be removed from the bench and brought up on charges of gross misconduct. Based on DSS interruption any parents that argues is guilty of abusing their children!  This is OUTRAGEOUS!

With out any evidence of a crime, this family was convicted. DSS will destroy your family, kidnap your children all with no fear of accountability from the legal system.    District Attorney John Conte, and the Massachusetts state police once again have failed the children of Worcester county !

Judge agrees with diocese; throws out papers in suit

SPRINGFIELD- Judge John A. Agostini of Hampden Superior Court has upheld the Diocese of Worcester's contention that certain documents be stricken from Jane Martin's lawsuit against the diocese involving allegations of sexual abuse by the Rev. Robert E. Kelley.
Ms. Martin's lawyer, Michael P. Ascher, accused the judge and the legal system in Massachusetts of further victimizing Ms. Martin and said the judge has effectively taken away Ms. Martin's claims that the diocese acted beyond the scope of its charitable purpose when it allowed Rev. Kelley to continue as a priest.

Mr. Ascher said Ms. Martin met April 14 with Bishop Daniel P. Reilly, who has since retired. Bishop Reilly "looked her in the eye and promised to settle her case before Bishop McManus' arrival," he said.
"He asked her to draft a written letter with an itemization of what she needed to settle her claims. She apparently did so and delivered it to Bishop Reilly. She followed up with several telephone calls, and we were then served with a letter that essentially told Jane to stop communicating with the bishop directly, although he had solicited the letter," Mr. Ascher said.

Voice note: This "repulsive"  scandalous behavior by Bishop Daniel Reilly, once again PLAINLY illustrates that still in 2004, the Worcester dioceses is still demoralizing victims and spending the faithfuls money on SELF PROTECTION.  DA Conte's continued failure to even investigate the diocese is once again evident.  DA Conte, still gives his campaign money to the church and ADA Christopher Hodgesn and State police captain Thomas Greene have received professional promotions, with financial rewards, all while NO prosecution has occurred.

Were are the prosecutions for clergy sexual abuse from DA John Conte's office? After two years plus of secret grand Jury subpoenas, why has Bishop Daniel Reilly, Monsignor Thomas Sullivan, Monsignor Edmond Tinsley, and Auxiliary Bishop George Rueguer, himself accused of clergy sexual abuse never been questioned by C-Pac state police detectives, in Auburn attached to John Conte's office. What type of investigation, if any has occurred, and who does go to trial?

Shame on, ADA Christopher Hodgens, of Hopedale for this cover-up and Captain Thomas Greene, of Blackstone for their commitment to self preservation, and advancement of their own personnel careers at the expense to safety of innocent children. As we know, since 2002, when the clergy abuse crisis was revealed both received from DA John Conte recent promotions with financial rewards, yet no real prosecution has ever occurred in Worcester.

Figure in Holley parole fired

N.M. gov. outraged over handling of convicted sex offender

New Mexico Gov. Bill Richardson yesterday fired the executive director of the Adult Parole Board for his handling of the parole of the Rev. David A. Holley, a convicted sex offender.

Rev. Holley, a priest of the Worcester, Mass., Catholic diocese, was serving a 55- to 275-year jail term for sexually abusing eight boys in the Alamagordo area. He pleaded guilty to the charges in 1993. He was quietly paroled on May 26 after 11 years of incarceration, without the victims being notified.

Holley's parole a mistake N.M. failed to tell molested victims

WORCESTER- The Rev. David A. Holley, a priest of the Diocese of Worcester serving a maximum 275-year jail term in New Mexico for molesting boys in that state, is still in prison although the state parole board agreed to release him in May.

Plans were to release the 77-year-old priest with "stringent conditions" including six to 12 months of treatment at a state inpatient center for sexual offenders in northern New Mexico, he said. The state would pay the costs of treatment, he said.

Mr. Saviano gave a statement to state police in the early 1990s and met with an investigator in the office of District Attorney John J. Conte, he said. Mr. Saviano decided not to go forward with criminal prosecution after Rev. Holley received the lengthy jail term in New Mexico, because he believed the priest was in no position to harm more children, he said.

Rev. Holley was ordained as a priest in Worcester in 1958. He served several parishes here until leaving the state in 1969. The Worcester Diocese sent him to the now defunct treatment center operated by the Servants of the Paraclete in New Mexico, which is how he got to that state.

SOUTHBRIDGE - Parishioners at St. Mary's Parish are bewildered at the contempt and fiscal mismanagement regarding how the Worcester Diocese and newly-installed Bishop Robert McManus have handled the construction of the new parish center. We are concerned that neither gave a proper and true evaluation of the situation at the parish center.

It is devastating to read in our current St. Mary's church bulletin that you have approved the removal of two sides of the new parish center and are contemplating the demolition of the entire building. This action would be an exorbitant waste of money. These resources could have been better spent feeding the poor, caring for the elderly, or housing the homeless.
