Offender priest got outsource Masses

Bishop forwarded special requests

WORCESTER- Bishop Bernard J. Flanagan outsourced to the Rev. David A. Holley Masses that Catholics of the Worcester Diocese sought for special intentions while the priest was undergoing treatment in New Mexico for a psycho-sexual disorder.
"People in the Worcester Diocese would send in donations - usually $3 to $5 - for Masses to be said for a loved one," Rev. Holley said in the affidavit. "However, Worcester is a small diocese, and the priests there could not accommodate all the Mass intentions.

"Therefore, Bishop Flanagan sent the donations and prayer requests to me in New Mexico with instructions that I, as a priest of the Worcester Diocese, pray for the Worcester parishioners by saying Masses for them in New Mexico to fulfill their spiritual intentions," he said.
Raymond L. Delisle, spokesman for the diocese, said he could not speak for what may have happened back then, but that he does not believe the diocese is currently outsourcing Masses. The intent is for Mass intentions by parishioners to stay within their parish community, he said.

Voice note: Mr. Delisle, states he "does not believe" which means in reality he has no idea.  Bishop McManus needs to address this issue immediately and tell the truth on the out sourcing of theses masses.  Additionally has then been the method of finical support Worcester priest sent away after molesting children?

Bishop indicted for rapes

Springfield DA says trial cannot be held
SPRINGFIELD- District Attorney William Bennett said yesterday he will not prosecute former Springfield Bishop Thomas Dupre for child rape charges because the statute of limitations has expired.

In a grand jury indictment unsealed yesterday, Dupre was charged with molesting two boys in the 1970s, becoming the first Roman Catholic bishop to face criminal charges in the sex abuse scandal in the American church.

However, the grand jury returned indictments related directly only to child abuse, and not to other possible charges, such as witness tampering and obstruction of justice. Without those indictments, Bennett said he was precluded from pursuing the case because the statute of limitations at the time of the alleged crimes was six years.

Voice note  District Attorney John Conte has had in his possession indictable information on Bishop Daniel Reilly since 2003, DA Conte has refused to even convene a grand jury to investigate the Worcester dioceses.  DA Conte continues to provide protection to the Worcester Diocese with his fraudulent use of a Grand Jury subpoena.  Perhaps it is time to charge Worcester District Attorney John Conte.

Catholic advocates eye nearing election
Diocese will hold voter registration Diocese eyes voter registration

WORCESTER- The Diocese of Worcester has issued a call for each parish to appoint a public policy advocate to attend one of two meetings to be held Wednesday at Ascension Church.

In a Sept. 23 memo to all pastors, the diocese suggested that the advocates could be drawn from parish marriage amendment coordinators, those people who worked for a constitutional amendment to ban same-sex marriage; people who are anti-abortion representatives, and people who support church teachings on end-of-life issues.. .........The Wednesday meeting, which will have sessions at 11 a.m. and 7 p.m. at Ascension Church, 40 Vernon St., was spurred by a meeting for all diocesan priests that Bishop Robert J. McManus called Sept. 9. Former Vatican ambassador Raymond L. Flynn was the speaker.

Mr. Flynn said in a recent interview discussing his Catholic Citizenship initiative that only about 60 of the 130 invited priests attended, and he was disappointed with the turnout.

He said the diocese also had two lawyers present.

DA Conte has established a pattern of criminal investigation into lawyers who oppose him.

In little over one year’s time, three different lawyers’ Texas Lawyer Daniel J. Shea, Gardner lawyer Gary Leblanc, and Fitchburg Attorney John Bosk find themselves subject of criminal investigation by Worcester District Attorney John Conte and his C-Pac Massachusetts State Police unit.

Flamboyant Texas attorney Daniel J. Shea, who has had numerous public run-ins with DA Conte and the Worcester diocese, became the subject of a state police criminal investigation involving allegations that DA Conte could find no evidence to back-up. We know this because Atty. Shea was provided with the report numbers that he should look for in securing these documents so he would know what the DA and the Massachusetts State Police were up to. Atty. Shea has stated publicly that he and Joseph DiGenova, a former federal prosecutor, believe DA Conte was guilty of “prosecutorial misconduct.’’ This was said in relation to a alleged victim of Rev. Gerard Walsh, who at the time was a chaplain for the Massachusetts State Police. This alleged victim had secured a signed document from the priest that indicated there had been an improper incident with this person and there was an apology. The alleged victim turned the document over to state police for investigative purposes.

Depositions taken in a civil suit show that an unnamed high-ranking official of the Massachusetts State Police turned the document over to the Worcester diocese. The alleged victim never intended for that to happen. Mr. Shea has repeatedly said that the DA should be investigating the church and not causing problems for the victims.

Lawyer denies he aided teenage drinking party

FITCHBURG- A prominent Fitchburg lawyer accused of providing alcohol to underage drinkers at his house last Halloween was arraigned yesterday in Fitchburg District Court.

John A. Bosk Jr., 53, of 917 Ashby State Road, was not present in court for the arraignment. His lawyer, Elliot M. Weinstein of Boston, appeared before Judge Elliot L. Zide and denied the charges on his client's behalf.

Attorney facing liquor charges

FITCHBURG -- A district court clerk has found probable cause to charge local lawyer John A. Bosk Jr. with 12 counts of providing alcohol to minors at his teenage son's Halloween party, according to court officials and the man's lawyer.

Weinstein said the charges stemmed from a State Police investigation into an October 2003 party hosted by 17-year-old Joseph Bosk, the lawyer's son, who died in a motorcycle accident in June.

Elizabeth Stammo, spokeswoman for District Attorney John Conte, confirmed the existence of the 12 charges Monday but declined further comment.

"I don't speculate on the motives of pursuing a lawyer who has aggressively fought for his clients," Weinstein said.

Bosk has frequently represented local clients charged with significant drug crimes and other high-profile cases, and often assails the methods police use to charge a suspect when defending clients in court.

"He has provided effective representation to unpopular clients," Weinstein said.

Voice note: DA John Conte uses his state police C-pac unit to investigate his adversaries one more time. Again, we see a "SUBJECTIVE" investigation by Captain Thomas Greene who operates solely on DA Conte's string. Under the current tragic circumstances, it is probably not possible for DA Conte to stoop any lower. 

Captain Greene can't solve the Scola or Bish murder cases. State police investigations have failed to gain convictions in the last three clergy sexual abuse trials. Never mind the recent eight (8) murders this summer in Worcester nor the three woman having disappeared and been found murdered from South Main area. It appears Captain Greene can however, investigate a Halloween party.

Diocese wanted Rev. Holley out

Personal letters detailing priest's situation obtained by T&G

WORCESTER- Bishop Bernard J. Flanagan in 1971 decided that one reason the Rev. David A. Holley should go into the care of Servants of the Paraclete in New Mexico or some other location operated by the order was because they would be able to find a placement for him after he completed treatment, the bishop said in a letter written at the time.

Bishop Flanagan in a Feb. 11, 1971, letter to Bishop Mardaga, said he did not believe Rev. Holley should continue ministry in Worcester after treatment at Seton Institute for what the bishops called "a homo-sexual problem." He told the Wilmington bishop that there had been "at least two incidents" involving Rev. Holley but "they did not evoke wide public scandal" but did become known to several priests and lay people.

"In this very compact diocese, it is practically impossible to transfer a priest to a place where his previous history is not known - at least by the priests of the diocese," he said.

Rev. Holley contacted the Worcester Diocese in 1992 and requested that they cover health and dental insurance. Rev. Rocco Piccolomini, vicar for priests, said his request was being considered. Rev. Piccolomini said in the "charity of the Lord" the diocese accepted his need for money and sent him $500.

Voice note: Were is the "charity of the lord" for the victims and families who to this day are still being ABUSED by the Dioceses of Worcester?  Never mind the secondary victims who lives were destroyed to maintain diocesan "DIRTY" secrets.  Again, plainly illustrated is the failure of District attorney John Conte and the C-Pac State Police unit attached to his office.

Ray Flynn urges Catholics to get involved

WORCESTER- Former Vatican Ambassador Raymond L. Flynn, a Catholic layman who has become involved in the Catholic Citizenship campaign, is reaching out to Catholics who do not vote or get involved in political issues.

Mr. Flynn, who served as U.S. ambassador to the Vatican under President Clinton, addressed a group of diocesan priests here on Sept. 9 at the request of Bishop Robert J. McManus. He was not entirely pleased with the turnout. A total of 130 invitations went out to priests from Bishop McManus. Only 60 showed.

"There should have been more," Mr. Flynn said.

He was unsure why the turnout was low. According to Mr. Flynn, one priest said he had trained to be a priest and not a politician. Catholic Citizenship is not asking priests to become politically involved, Mr. Flynn said, but to help people realize they have a duty to vote.

New Mexico board denies parole for Worcester priest

WORCESTER- The Rev. David A. Holley, a priest of the Worcester Diocese serving a jail term in New Mexico after pleading guilty to sexually abusing and raping eight boys there, has been denied parole and will remain behind bars.

The late Bishop Timothy J. Harrington told a psychiatrist on July 27, 1970, that "Bishop (Bernard J.) Flanagan and I have had such serious doubts about Father (Rev. Holley) continuing in the priesthood that, at one time, it was suggested that he seek a dispensation and return to the lay state."

His last three parish assignments in the Worcester Diocese were what priests would consider "ideal," Bishop Harrington said. "In each place, Father's difficulty came to the fore and caused us to give him leave of absence."

Cop clash is she said vs. he said

State, local officers in roadside dispute

Worcester Detective Laura Laliberte said Trooper Steven Hennigan ignored her repeated - and eventually heated - assertions that she was an on-duty Worcester police officer after he pulled her over Friday night on Interstate 290, and tried to intimidate her by pushing her and putting his hand on his gun.

She said the trooper also grabbed her wrist, put his hand on his gun in an intimidating manner and blocked her attempts to return to her cruiser.

"I really thought he wanted to get into a shootout on the side of the road," Officer Laliberte said. Then, when the trooper demanded that she produce identification, she told him her ID was in her cruiser.

"I got in my car, rolled up the windows, locked the door and took off," she said. She said she immediately reported the incident to the sergeant on duty.

Voice note: The division of standards and practice, of the internal investigations of state police have been found to be corrupt.  April of 2004, Major John A. Burns, brought a satchel of internal affairs reports that were "SQUASHED" to Stephen Huggard, assistant US attorney in charge of the public corruption unit. 

Currently, Captain Frank Moore appointed in June, 2004 by Col Thomas Robbins is director of the State Police internal affairs division.  February 2003, then Lt Moore Commander of C-Pac unit was removed by Worcester DA John Conte, abruptly and replaced with recently promoted Captain Thomas G. Greene.

Catholic voters get tips from bishops
Guides list candidates’ stands on issues

Many Catholic voters in yesterday’s primary received e-mailed voter guides from the Massachusetts Catholic Conference, explaining where legislative candidates stand on issues of concern to the state’s Catholic bishops, including Bishop Robert J. McManus of Worcester.

The conference is the political and lobbying wing of the state’s Catholic bishops.

Voice note: Now perhaps the average catholic can see the political connection between Worcester dioceses and elected officials. The TRUE reasoning why the Catholic Bishops have not been criminally prosecuted in Massachusetts, now is vividly obvious.

New Mexico clergy abuse case, a result of failure of Worcester dioceses to protect children.

Area victims of clergy sexual abuse are watching closely today, Sept. 14, as events unfold before the Parole Board in New Mexico.

Father David Holley, who was ordained as a Worcester priest in 1958, is coming up for a parole hearing. He has served only 11 years of a sentence of 55 to 275 years after he pled guilty to molesting and raping boys in New Mexico. Father Holley was able to commit these despicable crimes against children and young people because he was sent there by the Diocese of Worcester. He was supposed to be receiving pedophilia treatment from the Servants of the Paraclete but was let loose into the area where he was able to satisfy his sexual appetite for young boys.

Worcester DA Conte changes pending clergy page of web site.

Last week after failing to gain a conviction in the third straight clergy abuse cases of which investigation was conducted by his Auburn C-Pac State Police unit, currently commanded by Captain Thomas G. Greene, District Attorney John J. Conte has removed the pending clergy case portion, which had been of question lately, from his clergy web link.

For over a year, Worcester advocates have been proclaiming false illusions within the walls of 2 Main Street, Worcester. What District Attorney John Conte has been publicly releasing and what is actually occurring within his tightly controlled political network, organized over the past 28 years differs tremendously.

Last Friday morning, Worcester Telegram front page headlines proclaim settlement in clergy abuse case, yet in reality court reporter Garry Murray, wrote his story out of old court filings. The hearing that was scheduled to occur in front of Justice Jeffery Locke, to review the current status of clergy abuse cases within Worcester did not occur.  Reporter Murray also notability failed to insert in the settled Kelley case, the other plaintiffs publicly declared they only dropped participation in the civil suit under threats by Travelers Attorney Joann Goulka. Of the cases he reported, no actual terms of settlement were disclosed by Attorney James G. Reardon diocesan lawyer.  Conspicuously, not one victim, or advocate was interviewed for this story.

The Charter for the Protection of Children adopted by the American bishops in 2002 mandates that each diocese not keep settlements secret and that amounts of settled court cases be made public. This is not being done by the Diocese of Worcester. The only way the Catholics of the diocese know how much of their money - or the insurance company's money - goes to settle these cases in when a victim makes it public. 

According to the claims of clergy abuse page on his web site Worcester DA Conte states, part of the obligation as a citizen of our commonwealth is to assist its authorized officers in discovering and prosecuting those suspected of being engaged in the commission of crime.  One could wonder were is the legal and moral obligation of Thomas G. Greene, Massachusetts state police captain to conduct true and factual investigations?

We know that Bishop Daniel Reilly reassigned in December 2001, directly after a $300,000 secret settlement, involving sexual abuse allegations.  Rev Peter Inzerillo was only removal after legal representation was hired by parish parents.  Worcester ADA Christopher Hodgens failed to forward incriminating material to the Auburn C- Pack unit for investigation of the Worcester dioceses and Bishop Daniel Reilly.  Today, Rev Inzerillo currently faces an additional 2004 civil suit alleging sexual misconduct in the buildings of St Leo Parish.

Two year after the clergy sexual abuse crisis has broke in Worcester, we are still in the same secret settlement stage, with secret meetings, with secret names all kept secret by DA Conte issuing a grand jury subpoena without conveying a grand jury which he knew would kept the information secret from the people of Worcester county.  Good thing we can all cast a secret ballot in 2006, it appears to be the "peoples" only hope.

Priests huddle on role in election

WORCESTER- Bishop Robert J. McManus last night called together priests of the Diocese of Worcester for a private meeting with former Vatican Ambassador Raymond L. Flynn on how priests can play a role in the November election while staying within the law.

Raymond L. Delisle, diocesan spokesman, said the meeting was closed to the public and press "so that the priests will feel comfortable talking and asking questions." The meeting was held at St. Paul's Cathedral.

Bishop McManus said Mr. Flynn can present his "unique perspective" on political and moral responsibility.

Voice note: Why would this have to be a secret meeting?  Once again see deceptive practices by the Worcester dioceses.  Who knows what went on in this meeting.  Why does Bishop McManus have to operate in secret???

Settlement reached in Kelley suit

Abuse was alleged at St. Cecilia’s

WORCESTER- The Worcester Diocese has reached an out-of-court settlement with an Idaho woman who filed a civil lawsuit two years ago alleging she was sexually abused as a child by the Rev. Robert E. Kelley.

One of the two victims in the criminal case was Diane Gallian of Ashburnham, who is now the sole remaining plaintiff in the civil case in which Ms. Hanrahan was also a plaintiff.

DA CONTE has removed Rev Andrew Bierkan from his web site.

Now what about Rev. Donald Ouellette who is listed with clergy sexual abuse cases, one could wonder why?  In his case, Captain Thomas G. Greene, Commander of the C-Pac unit has failed to locate $200,000 that was unaccounted for. Judge Agnes told Rev. Ouellette his account of what he did with the stolen money "doesn't have the ring of truth.

Hmm...  Amazingly, somehow the sexual abuse civil suit against Auxiliary Bishop George Rueguer was dismissed mysteriously when Sime Braio, 52, of Shrewsbury, claimed he spoke with Trooper Greene. Mr. Braio told Superior Court Judge Tina S. Page, Trooper Greene of the Auburn barracks, told me to do this. The very same Captain Thomas Greene, who works under direct, direction of Worcester DA John Conte.

The question can be placed, could this be, there was an incident when the need of a quick cash arrangement for the interaction between Mr. William LaMontagne, 43, of Rhode Island, a convicted child rapist, who has alleged that Rev. Ouellette gave him some of the stolen money appeared ? Mr. Daniel St. Francis of Whitinsville, who Rev Oullette claims was the recipient of the money was not charged with receiving stolen property.  After all the Bishop assigned  Rev Oullette to Immaculate Conception parish in Fitchburg, February 2001. According to Mr. Conte, the thefts allegedly occurred between March 15, 2001, and Jan. 2, 2003.

We do know that the parish members reported the missing money, not the Worcester dioceses. The parishioners also questioned the 'bookkeeping by the Worcester dioceses" vehemently, perplexed by how such a large amount could be withdrawn without cause.

Just a question to ponder, were is that unaccounted for money?

Former Sutton minister acquitted of sexual assault
WORCESTER- The former pastor of a Sutton church was acquitted yesterday on child sexual assault charges..........
Mr. Noonan noted that the alleged victim did not report the allegations to police until 2002. He said the delay in reporting, coupled with discrepancies in the woman's various statements and the "preposterous" nature of some of her claims provided reasonable doubt in the case.

Judge Timothy S. Hillman found Rev. Bierkan not guilty of both of the charges against him.

Voice note: The Worcester Telegram missed the real story.  However, as many of us know in the halls of 2 Main Street, it is Conte country.  He will prosecute who he pleases, and allow his friends a free pass, then hide in his office, and it has become obvious that the management of the telegram is content to let him get away with it.

Worcester DA John Conte clergy abuse conviction still zero (0) accused three (3)

 

Rev. Andrew Bierkan, a minister of the United Church of Christ, not guilty.

 

For the third time since May 2004, Worcester DA John Conte’s investigation into childhood sexual abuse by a clergy member failed to gain a conviction.

 

The travesty of justice we see unfolding before our eyes in Worcester has reached a high level.  District Attorney John Conte and his staff of have failed to prosecute successfully one (1) clergy abuse case since the crisis broke in 2002.   

 

While the Massachusetts trial court computer which handles the entire state of Massachusetts was updated this afternoon,  DA John Conte’s web site was as of 5:15 pm Wednesday, still had not posted the not guilty verdict on both charges in the allegations brought against Rev. Andrew Bierkan, former minister at the Sutton Congregational Church.

 

Woman says ex-Sutton minister molested her starting at age 6

WORCESTER- A Tennessee woman testified yesterday that a former Sutton minister molested her on three occasions, beginning when she was about 6 years old, and also took photographs of her while she was partially nude. ...............
The woman said the two men spoke and Rev. Bierkan then came over to the pew, knelt beside her, put his hand beneath her dress and sexually assaulted her. When Rev. Bierkan stood up, she started to leave again, but was stopped by Mr. Rixham, who put his hand on her shoulder, the woman said. She said Rev. Bierkan told Mr. Rixham she could go and she left.

In his opening statement, Rev. Bierkan's lawyer, Mark E. Noonan, said Mr. Rixham would be called as a defense witness and would testify that the incident never occurred. Mr. Noonan also said Mr. Rixham was interviewed by police earlier this year and was not charged. Mr. Noonan said the woman's allegations, if believed by police, could have made Mr. Rixham a "potential accomplice" in their eyes.
