Do I need an Advocate

Why do I need an advocate not a lawyer: because Mass Independent Child Advocate's specialize in DSS procedures where as most lawyers are trained in the Massachusetts General Law not DSS regulations.

Are you currently under investigation (51B) by the Department of Social Service.

Has the Department of Social Service showed up in your children's school or at your house unannounced?

If you have answered yes to either of these questions you need an advocate.

The majority of the time when DSS comes to your house you have not met the criminal criteria to be charged with a crime.

An independent advocate gives you and your family a voice in the process while also giving you someone who understands the rules and regulations that DSS must follow.

Families who have advocates have a better chance of having a 51A unsupported.

File documentation in regards to an investigation placing your version in the case file.

Cost associated with an Advocate is less expensive than with a lawyer.

On Call for emergency situations.

Reasonable rates/sliding fee scale

Why DSS will tell you, you do not need an advocate:

DSS does not want you to have an advocate because this will make them follow the rules and regulations.

DSS claims to want to help your children by finding you "supported" of neglect or abuse.

Because they claim they are there to help you the parent

DSS does not want you to know your rights regarding the filing of a 51A or 51B investigation.

DSS wants to ask your children any question they seem fit without remaining on subject matter or your consent.
